Humanity Shared, LLC, is defined to include its owner, Taylor White Moffitt and Kim Locke, its representatives, agents and affiliates (collectively referred to herein as “Humanity Shared”) I, the undersigned guest, consent that this retreat, workshop or training is for educational purposes ONLY. As the facilitators are not practicing or serving the role as psychotherapist or giving mental health advice and that if at any time I need professional advice I consent to seek a professional certified and licensed therapist in my location. LIABILITY RELEASE FORM Humanity Shared does not own or operate any entity which will or does provide goods or services for your trip, including but limited to, ownership or control over hotels or other lodging facilities, airlines, vessels, buses, vans or other transportation companies, local ground operators, providers or organizers of optional excursions, food service or entertainment providers, etc. Humanity Shared, LLC is not liable for any act or failure to act of any such person or entity, or of any other third party. Without limitation, I acknowledge and agree Humanity Shared is not responsible for any injury, loss, or damage to person or property, death, delay or inconvenience in connection with the provision of any goods or services occasioned by or resulting from, but not limited to, acts of God, force majeure, acts of war or civil unrest, insurrection or revolt, strikes or other labor activities, criminal or terrorist activities of any kind, overbooking or downgrading of accommodations, structural or other defective conditions in hotels or other lodging facilities, mechanical or other failure of airplanes or other means of transportation or for any failure of any transportation mechanism to arrive or depart timely, dangers associated with animals, marine life or vegetation of any sort, dangers incident to recreational activities such as scuba diving, snorkeling, swimming, kayaking, sailing, canoeing, rafting, hiking, bicycling, rock climbing, etc., sanitation problems, food poisoning, lack of, access to or quality of medical care, difficulty in evacuation in case of medical or other emergency, or for any other cause beyond the direct or indirect control of Humanity Shared. ASSUMPTION OF RISK AND WAIVER I am aware that travels such as those which I am undertaking involve hazardous activities, some in remote areas of the world, with a risk of illness, injury or death which may be caused by forces of nature, or other persons and companies known or unknown, or of willful or criminal conduct of third parties. I am also aware that medical services or facilities may not be readily available or accessible during some or all of the time during which I am participating on the trip. I accept these risks and obligations and I fully assume the risks of travel. I fully and forever release and discharge Humanity Shared, LLC from any and all costs (including, without limitation, actual legal costs), claims, demands, actions, causes of action and liabilities whatsoever for any and all losses, damages, death or injuries to persons or loss of property, which may be sustained by me in connection with or in any way relating to this trip, due to any cause or reason whatsoever with exception to any willful or negligent acts of anyone associated with Humanity Shared, LLC. I agree that Humanity Shared, LLC will incur expenses before the trip to coordinate my participation in the trip. I agree and acknowledge that the expenses incurred by Humanity Shared, LLC on my behalf are based on non-refundable payments made to secure accommodations, transportation, ground operators, vendors, permits, and other third-party controlled aspects of the trip. I acknowledge that Humanity Shared, LLC will dedicate a significant amount of time and effort to secure my position on the trip and to make the trip a successful experience. I agree to the following terms of this Retreat Agreement: I will pay a non-refundable, non-transferable per person, per retreat, training or workshop deposit at the time of booking. This amount will vary with each program. The deposit amount will be specified on the registration page at the time of booking. Payment of the balance is due by the date specified on the retreat, workshop or training registration page and invoice. Travel rates and accommodations cannot be guaranteed to guests if I fail to pay the full amount due by the due date specified on my invoice. Should Humanity Shared deem it necessary to cancel the scheduled retreat, training or workshop after receipt of my payment, Humanity Shared, at its discretion, will refund the payment to me or apply the payment toward a future offering. Any cancellation by me must be made in writing and be acknowledged by Humanity Shared in writing. I will not be entitled to any credit toward a future Humanity Shared offering after my cancellation of the retreat. CLIENT CANCELLATION & FEES The date on which my request to cancel is received by Humanity Shared will determine the cancellation fees applicable. If Humanity Shared receives my request to cancel ninety-one (91) days or more before the trip departure date, Humanity Shared will retain the entirety of my deposit plus any amount incurred by Humanity Shared on my behalf up to the date of cancellation. Should any transportation ticket or tour permit be purchased in my name, I shall pay the entire cost of that ticket or permit. Additionally, I will pay the cost of any special services, including, but not limited to, room upgrades, additional nights, or optional tours, requested by me. My payment made in excess of the deposit and expenses outlined above can be transferred to another retreat within one calendar year. If the expenses incurred by Humanity Shared exceed the amount paid by me up to the time of my cancellation, an invoice will be issued to you. Payment by me is due upon receipt of the invoice. If Humanity Shared receives my request to cancel ninety (90) days or fewer before the trip departure date, Humanity Shared will retain the entire trip price, including the deposit. If I cancel ninety (90) or fewer days before the trip departure date and I have not paid the trip price in full, I will owe the full trip price to Humanity Shared. TRAVEL INSURANCE Travel insurance is highly recommended for all retreat guests and I must provide coverage against cancellation, personal accident, death, medical expenses and emergency repatriation. Humanity Shared also strongly recommends that your travel insurance covers curtailment, personal liability and loss of luggage and personal effects. I acknowledge that the cost of the retreat does not include insurance, and that it is highly encouraged that I obtain separate coverage at an additional cost. If I elect not to purchase travel insurance, Humanity Shared will not be held responsible for reimbursement or refund for any and all reasons. PERSONAL RESPONSIBILITY Our guests have the responsibility to join a retreat/workshop appropriate to their physical and mental ability and interest. It is expected of each guest to act in accordance and with respect to the local custom, cultures and laws of the regions visited. Humanity Shared has the right to refuse anyone at any time during the trip if it feels the guest is physically or mentally incapable or if the guests continued participation will jeopardize the individuals or the group. Refunds are not given under any circumstances. Humanity Shared reserves the right to accept, retain or decline any guest at any time for any reason. The retreat guests' emergency contact will be responsible for any and all communication with law enforcement, the appropriate embassy, hospitals or judicial proceedings in the unlikely event that this is necessary. I understand and agree that this is not the responsibility of Humanity Shared. DISMISSAL FROM TRIP OR PROGRAMMING Humanity Shared retains the right to dismiss a guest for intimidating, threatening, or illegal behaviors or activities. A. Illegal or Illicit Substance Use. Ingesting Illegal substances or participation in illegal activities endangers travelers and our partners and programs. Illegal drug use could result in dismissal from the retreat or workshop and forfeiture of all costs, including reservations and tickets. Dismissal is left to the sole discretion of Humanity Shared. Humanity Shared is not responsible for any costs incurred as a result of participating in illegal activities, including, but not limited to, costs for medical care and court/incarceration proceedings. Any costs incurred by Humanity Shared as a result of these activities are the sole responsibility of me, and Humanity Shared will invoice the guest for immediate payment. B. Intimidating or Threatening Behaviors. By engaging in intimidating or threatening behaviors, a traveler puts Humanity Shared, its partners and other travelers in danger. Humanity Shared does not tolerate this behavior and retains the right to dismiss a traveler from a trip for engaging in this type of behavior. Dismissal is left to the discretion of Humanity Shared. Humanity Shared is not responsible for any costs incurred as a result, including, but not limited to, costs for medical care and court/incarceration proceedings. Any costs incurred by Humanity Shared as a result of these activities are the sole responsibility of the guest and Humanity Shared will invoice the guest for immediate payment. MEDIA RELEASE I, hereby consent and agree that Humanity Shared, its assistants or agents have the right to take photographs, videotape, or digital recordings of me from any Humanity Shared trip/event/activity and to use these in any and all media, now or hereafter known, and exclusively for the use of Humanity Shared. I further consent that my name and identity may be revealed therein or by descriptive text or commentary. I do hereby release to Humanity Shared all rights to exhibit this work in print and electronic form publicly for marketing purposes. I waive any rights, claims, or interest I may have to control the use of my identity or likeness in whatever media used. I understand that there will be no financial or other remuneration, either for initial or subsequent transmission or playback. KNOWING AND VOLUNTARY EXECUTION I have carefully read this Retreat Agreement and fully understand its contents. I am aware that this is a release of liability and a contract between myself and Humanity Shared and agree to sign it of my own free will. ELECTRONIC SIGNATURE ACKNOWLEDGEMENT AND CONSENT FORM I, agree and understand that by signing the Electronic Signature Acknowledgement and Consent Form, that all electronic signatures are the legal equivalent of my manual/handwritten signature and I consent to be legally bound to this agreement.
